Ⅱ. 청소년 성매매의 이해

1. 청소년 성매매의 개념

청소년 성매매라는 개념은 1980년대 일본에서부터 시작되었던 ‘원조교제’가 우리나라에 유입되면서 사회적인 이슈로 떠오르게 되었다. ‘원조교제’는 주로 성인 남성이 미성년인 여성에게 ‘원조’를 해 주고 그 대가로 미성년 여성은 ‘교제’를 해 주는 것을 지칭한다. 교제라고 하는 것은 데이트와 같이 식사를 한다거나 어딘가에 함께 놀러가 주는 것에서 각종 성적인 서비스, 성교행위까지를 포함한다. 이러한 ‘원조교제’는 1990년대 후반에 들어서면서 부적합한 용어라는 비판이 제기되었는데, 원조교제가 일회성 성행위만을 목적으로 하는 경우가 대부분이고 ‘원조교제’라는 용어는 이러한 성매매 행위를 미화하거나 정당화시키려는 의도가 반영되어 있다는 것이다(김혜원, 2011).
경찰청에서는 ‘원조교제’를 대체할 용어를 공모하였고 2001년 5월부터 ‘청소년 성매매’라는 용어가 사용되었다.

1) 청소년의 정의

청소년이란 “어른과 어린이의 중간시기로 청소년에 대한 연령규정은 법규마다 조금씩 차이는 있지만 청소년기본법에서는 9세이상 24세이하의 사람으로 규정”하고 있으며 일반적으로 청소년은 만13세에서 만18세사람으로 칭하며, 통상적으로는 중학교와 고등학교 시기의 연령대를 청소년기에 해당된다. 아동 복지법은 18세미만의 자를 아동으로 규정하고 있으나, 청소년기본법은 9세 이상 24세 이하의 자를 청소년으로 규정하고 있다. 또 한 민법에서는 만 20세 미만의 자를 미성년이라고 하고 있으며, 소년법에서는 19세 미만의 자를 미성년이라고 규정하고 있다(성윤숙,2011)
청소년기는 시기는 신체적으로 이미 성인의 수준에 이르고 있지만 성인으로 대우를 받지 못하고 있다. 시대가 발전하면서 청소년들의 신체적 성숙이 빨리 진행되면서 현저한 성적 성숙에도 불구하고 성적 행위가 사회적으로 금기시 되어 있어 사회적인 문제를 일으키고 있다. 이들은 자아의식이 고양되고 독립과 해방에 대한 욕구가 강화되는 시기인 만큼 거기에서 생겨나는 기성세대간의 부정의 경향이 전통적인 가정ㆍ사회의 존재양식과 때때로 충돌을 일으키기도 한다.
